I think you have to get the first one although oddly they are not gaining an advantage on an onside kick. They are just careless in complying with a fairly simple rule. You'd like to catch them in advance, but they did this just before the kick so it's on them.
The second one would be too technical IMO. He's almost right behind the kicker when it's kicked. The primary intent of this rule is to prevent a bunch of players at the POA of an onside kick. This guy is nowhere near that so I'm less inclined to be technical on this particular formation.
