The rule states that the play is dead once it is apparent the kick try will not score.  Here is a scenario:

K holder muffs the snap during a try.  To avoid the rush.  K's kicker kicks the loose ball backward.  K82 recovers the loose ball and advances into the end zone. 

Would the illegal kicking of the ball constitute the "kick try apparently not scoring" thus killing the play, or would you allow the play to continue?

The kick try not scoring is referring to a legal scrimmage kick. This can be inferred because only legal kicks can score points.

In your description, we have an illegal kick of a loose ball. I would not whistle this play dead until K82 crosses goal line, at which point we will enforce the illegal kick penalty - 15 yards from the spot of the kick, replay the try.

An illegal kick is not a kick by definition. An illegally kicked ball retains its previous status, which would be a fumble or muff
