"Judiciously broad in scope" is an understatement. It's like saying you can make up the rules as you go along.
Thankfully, that is essentially the message being sent, to avoid endless dispute. However, as we should all understand, and accept, there is a heavy responsibility, with appropriate consequences, associated with invoking this rule, that it is ONLY used judiciously.
