Interim South San chief, others handed subpoenas

Nearly a dozen employees of the South San Antonio Independent School District, including the interim superintendent, were subpoenaed Monday by a grand jury investigating allegations of missing district athletic funds, a district spokesman said.

The athletic department is overseen by Gary Durbon, whose father, Ron Durbon, was superintendent and is now fighting to reverse his firing.

The younger Durbon is embroiled in a legal battle with two school board members over accusations that pornography was found on his district computer, a claim Gary Durbon denies. Ron Durbon's handling of the controversy was cited as one reason he was fired this summer.

The Bexar County district attorney's office is looking into the handling of money from South San athletic events.

“There are allegations that there was no money deposited at all from a particular sporting event,” First Assistant District Attorney Cliff Herberg said. “There are other instances where they know a certain amount of ticket sales were made but the deposit was short.”

Herberg said the amount of missing money could range from several thousand dollars to the low tens of thousands.

Gary Durbon said he had not received a subpoena as of Monday evening and had no comment about the investigation. He sued board President Connie Prado and trustee Karyn Tomlinson claiming defamation about the spread of the pornography allegations.

The district has conducted a financial audit of the athletics department and will receive the final report Oct. 19, said district spokesman Ed Suarez.

The board hired an outside auditor after hearing allegations that the athletics department was paying some workers in cash, and that groups were being charged inconsistent rates for facility rentals, Prado said.

The board selected Smith, Patterson & Johnson to conduct the audit and heard preliminary findings in July. At that meeting, the board voted 5-0, with two trustees abstaining, to give the auditor permission to inform the district attorney's office of its findings.

While Douglas Poneck, one of the school district's attorneys, did not comment on whether subpoenas had been served, he said, “These subpoenas confirm that the board's concerns are serious. ... Undoubtedly, they're coming as a result of the board's forensic audit.”

Naaahh!  pi1eOn They wouldn't ever dream of doing that!! Well, I'd have to wager the farm on one thing: Bet those "Stripes" ended up getting paid the absolute minimum gates~ if anything at all!

Now what is a better reason for all crews to start filing FOI requests to all school districts to see exactly what the true gate is and where all the school district expenses are going!  z^

Seems as if this is a trend today:

http://www.statesman.com/news/local/former-anderson-high-football-coach-charged-with-theft-1906346.html

A former Anderson High School football coach who resigned in May stole thousands of dollars meant for the school's athletic program, according to an arrest affidavit filed Monday .
Mark Reiland was placed on administrative leave by the district in April and stepped down shortly thereafter. He has not returned calls for comment since.
At the time, officials were unclear about the reasons for the departure of the 40-year-old coach who led the Northwest Austin school to its most successful season since opening in 1973 and to its first postseason win last year.
"We were stunned (in the spring) when we learned there might have been some improprieties (concerning Reiland). It's something we never expected," Principal Donna Houser said Monday. "I like Mark personally, ... and I hate it for (the family), but we can't tolerate any kind of financial problems."
Police think Reiland was using the money, at least $6,500, to fuel a gambling addiction, of which school officials said they were aware, the affidavit said.
The charge — theft by a public servant, a third-degree felony — comes after a months-long investigation that began in April when a parent told the school that Reiland was trying to cash a check the parent wrote out to the school for her son to attend a strength and conditioning camp put on by the school, the affidavit said.
Between February 2007 and April 2011, Reiland cashed checks written out to the school, but he also requested donors to write checks meant for the athletic program to him personally, the affidavit said.
A pawn shop's records showed that Reiland had pawned his wedding ring as well as school property such as computers and projectors, the document said.
A former co-worker of Reiland's at Anderson told police that Reiland pocketed money from concession sales and football camp registration fees, it said.
An Austin Independent School District auditor told police that $6,500 was missing from various Anderson athletic accounts, but Reiland could have stolen much more by keeping many payments off the books, the affidavit said.
Reiland, whose first name is spelled "Marcus" in the affidavit, was not in custody Monday. If convicted, he faces up to 10 years in prison.
"He is a good person who has suffered through bad things," school district Athletic Director Tommy Cox said. "I'm not going to condone what happened, but he's not a bad guy."

I wonder if the UIL would have required every coach to register with them if this could have been diverted?  What is crazy is they think it is horrible when we open records request their gate fees?  UIL take care of your own business before messing with TASO.  Do you possibly think there is "funny accounting" going on between season tickets and gate receipts???

And would you like to know what the official  :bOW Manor Road response will be? "Now this kind of stuff wouldn't ever happen if we were to successfully implement a 'flat fee', like we have placed in basketball," sayeth the  tiphat: Ringmaster!   z^

Just great!  I'm there two weeks in a row later this season.  I guess I can expect $45 checks for these 5A games.

Uhhh...no....you can expect NO checks.  I bet everything is on major league HOLD while they try to sort the mess out.  IF you get paid, look for it in the Spring/Summer.

So, as officials, we are just supposed to donate our time?  When we work a game, the understanding on pay it Net 30.  If they don't pay by 45 days, there could be some problems.

Wouldn't really matter.  The games have to be worked.  We will just work them and hope for the best.  Nothing I can do about it really.  This is just a sad situation.

But it seems to be on par with their SOP.

South San coach Jeff Smith has been suspended for one game for using inappropriate language toward his players, South San Antonio ISD ruled Wednesday.

Smith said he had an outburst at the Bobcats' practice on Monday. Sources said he used profane language toward a player and also used an obscene gesture.

He will miss the Bobcats' game at Corpus Christi King on Friday and first assistant John West will serve as interim head coach.

“It was the heat of the moment, and it was inexcusable on my behalf,” Smith said. “It shouldn't happen, it did, and I apologize profusely.”

South San ISD interim superintendent Linda Zeigler asked Smith to apologize to the Bobcats players and coaching staff. South San principal Sherry Moore had no comment.

“I expect our younger people to come forward and deal with consequences, and I'm doing the same,” Smith said. “I'm ashamed, and I need to be better.”

Smith is in his first season as a head coach and second season at South San. He was the Bobcats' special teams coach last year.

The Bobcats are 0-6 this season and are coming off a 31-6 loss against Corpus Christi Carroll.

Smith called the season “extremely trying” on Wednesday.

Smith's suspension is another incident involving the South San athletic department recently.

Smith replaced John Torres, who was the Bobcats' coach for eight seasons and filed a grievance citing wrongful termination.

On Monday, nearly a dozen South San ISD employees were subpoenaed by a grand jury investigating allegations of missing athletic funds from South San events. Athletic director Gary Durbon oversees the department.

Durbon also has sued school board President Connie Prado and trustee Karyn Tomlinson for defamation regarding allegations that he accessed pornography on his work computer.

“This has nothing to do with any of the other situations,” Smith said. “It just happened, and I'm owning up to it.”

The whole situation in that ISD has stunk for years.  TEA will have to come in again and fix the problems and in-fighting.  The saddest part is that it is the kids that suffer.

By the way, I've met very few younger coaches that do not curse from time to time.  I just wonder if there is a player on the team whose parent is on the school board that caught the coach's wrath.

No, but truth be told I always seem to do at least one game each year "for the love of the game" while others don't send the check until well into Jan/Feb.

In 24 years I have never done a game for free.  I keep very close records and follow up whenever someone seems to have forgotten.
